2. No paid contract on this website

This website is an informational personal site. Browsing it does not create an account, a subscription, or a duty to pay. A paid contract is formed only where another service of ours says so in its own terms and you place an order there. Linking to Fred, Sunny Days Ahead, or a social profile does not by itself form a contract.

3. Intellectual property and portrait

The text, layout, and photographs on this website are protected by copyright. Photographs of Sebastian Frederik Jacobsen are also protected by the right to control the use of one’s own image. You may view the pages and share links to them. You may not copy the site, present it as your own, or reuse the photographs commercially, unless a written licence or a statutory exception allows it. The names Fred and Sunny Days Ahead identify our services.

4. No professional advice

Content on this website is general information about the person and the projects. It is not legal, medical, financial, tax, or travel advice, and it is not an offer to conclude a contract unless a page says so expressly.

5. Acceptable use

You may not:

  • present SFJ Capital UG, HEJSFJ, or Sebastian Frederik Jacobsen as endorsing you without permission

6. Liability

We are liable under the following rules, and not beyond them:

  • We are liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), and for a guarantee we expressly gave.
  • For a slightly negligent breach of an essential contractual duty, liability is limited to the damage that is typical and foreseeable for this kind of contract. An essential duty is one that must be performed for the contract to be carried out properly and on which you may regularly rely.
  • Any further liability for slight negligence is excluded. These limits do not remove mandatory consumer rights, including conformity and update duties for digital products under §§ 327 and following of the German Civil Code (BGB) where those provisions apply.

7. Governing law and disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the EU or the EEA, you also keep the mandatory protections of your country of residence (Art. 6 of Regulation (EC) No 593/2008, Rome I). The courts of Ludwigshafen am Rhein have jurisdiction over merchants and other users who are not consumers. If you are a consumer, you may sue in the courts of your place of residence, and we may sue you only in those courts (Arts. 17 to 19 of Regulation (EU) No 1215/2012, Brussels Ia). We do not require arbitration. We are neither willing nor obliged to take part in dispute resolution before a consumer arbitration board (§ 36 of the German Consumer Dispute Resolution Act, VSBG).

8. Privacy

The privacy notice for this website explains how personal data is processed here. It is a separate document. Using the website is not consent to processing, and these terms do not replace a consent that the law requires.

9. Changes

We may update these terms by publishing a new version on this page and changing the date. The version on this page is the one that applies to later visits. Mandatory rights are unaffected.
