These Terms of Use ("Terms," "Agreement") govern your access to and use of:

  • HEJSFJ.com
  • The Fred app (available via https://fredgoals.com and https://app.fredgoals.com)
  • Any other websites, services, or applications operated by SFJ Capital UG ("SFJ," "we," "us," "our").

By accessing or using any of our services, you agree to be bound by these Terms. If you do not agree, you must discontinue use.

1. Parties & Contract Formation

1.2 Eligibility:

You must be at least 16 years old (or the legal age of majority in your jurisdiction) to use our services. Minors under this age may only use the services with parental/guardian consent.

1.3 Acceptance of Terms:

By creating an account, accessing the Fred app, or using HEJSFJ.com, you accept these Terms and our Privacy Policy.

2. Services & Functionality

2.1 Fred App Core Features:

The Fred app enables users to:

  • Create, edit, and track personal goals and milestones.
  • Add descriptions, completion dates, steps, and vision boards.
  • Use AI-powered features to generate goal suggestions (where available).

2.2 Availability:

We strive to maintain uninterrupted service but do not guarantee 100% uptime. Maintenance windows or outages may occur.

3. Accounts & Security

3.1 Registration:

To access most features, you must create a user account, providing accurate and complete information.

3.2 Account Security:

You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. Notify us immediately of unauthorized use.

4. Subscriptions, Payments & Billing (via Stripe)

4.1 Payment Provider:

We use Stripe as our payment processor. By subscribing, you agree to Stripe's Terms of Service and Privacy Policy.

4.2 Subscription Plans:

We offer free and paid subscription tiers. Paid plans may include premium goal-tracking features, AI-assisted goal generation, increased storage, and other benefits described on our pricing page.

4.3 Billing Cycle:

Subscriptions are billed monthly or annually, as chosen at checkout. Prices include VAT where legally required.

4.4 Automatic Renewal:

Subscriptions automatically renew at the end of each billing period unless canceled in accordance with Section 4.5.

4.5 Cancellation:

You may cancel your subscription at any time by:

  • Logging into your account and navigating to the Billing/Subscription page, or
  • Contacting us at hello@hejsfj.com.

Cancellation becomes effective at the end of the current billing period. No partial refunds are provided unless required by law (e.g., EU 14-day withdrawal right).

4.6 Free Trials:

If offered, free trials convert to paid subscriptions unless canceled before the trial ends.

4.7 Refunds:

Refunds are only granted where legally required (e.g., defective digital service under EU Digital Content Directive).

5. Intellectual Property

5.1 Ownership:

All software, designs, texts, and trademarks on HEJSFJ.com and Fred are owned by SFJ or licensed to us.

5.2 User-Generated Content:

You retain ownership of goals and content you create but grant SFJ a worldwide, non-exclusive, royalty-free license to store, process, and display such content solely for operating and improving the service.

6. Acceptable Use

You agree not to:

  • Use the services for unlawful purposes.
  • Reverse-engineer, decompile, or attempt to extract source code.
  • Interfere with the security, integrity, or availability of the services.
  • Upload malicious code or harmful data.

Violation may result in immediate termination of your account.

7. Data Protection & Privacy

Our Privacy Policy describes how we collect, process, and store personal data, including the use of Google Analytics, Stripe, and Vercel. By using our services, you consent to these practices.

8. Service Modifications & Termination

8.1 Changes:

We may modify features, pricing, or functionality at any time, with reasonable prior notice where legally required.

8.2 Termination by User:

You may stop using the services at any time.

8.3 Termination by SFJ:

We reserve the right to suspend or terminate accounts that violate these Terms or harm the service.

9. Limitation of Liability

To the maximum extent permitted by law:

  • SFJ is not liable for indirect, incidental, or consequential damages (including loss of data or profits).
  • Our total liability is limited to the amount you paid in the 12 months preceding the claim.

This does not affect mandatory rights under German or EU consumer protection law.

10. Warranties & Disclaimers

The services are provided "AS IS" and "AS AVAILABLE." We disclaim all warranties not expressly set forth in these Terms, including implied warranties of merchantability and fitness for a particular purpose.

11. Governing Law & Jurisdiction

  • EU/EEA Users: German law applies, and the place of jurisdiction is Ludwigshafen am Rhein, unless mandatory consumer protection law provides otherwise.
  • US/International Users: Where permitted, disputes will be resolved under binding arbitration in accordance with the rules of the International Chamber of Commerce (ICC).

12. Right of Withdrawal (EU Users)

If you are a consumer within the EU, you have a 14-day right of withdrawal from the date of subscription. By using Fred's digital services during this period, you acknowledge that you may lose this right once the full service is delivered.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on our sites. Continued use constitutes acceptance of the updated Terms.
